Client
Any professional or natural person capable under Articles 1123 et seq. of the Civil Code, or legal entity, who visits the Site subject to these general conditions.
Services
The elyadata.com website makes available to Clients a set of services described on the site.
Content
All elements constituting the information present on the Site, including texts, images, and videos.
Client Information
Personal data held by elyadata.com for customer relationship management and for analysis and statistical purposes.
User
Internet user connecting to and using the aforementioned site.
Personal Information
"Information that allows, in any form whatsoever, directly or indirectly, the identification of the natural persons to whom it applies" (Art. 4, Law No. 78-17 of 6 January 1978). Terms related to personal data have the meaning defined by GDPR No. 2016-679.

Terms of Use

The Site constitutes an intellectual work protected by the Intellectual Property Code. The Client may not in any way reuse, transfer or exploit all or part of the elements of the Site.

Use of the elyadata.com site implies full acceptance of these conditions. These conditions are subject to change at any time.

This site is normally accessible at all times. An interruption for maintenance may be decided by elyadata.com, which will communicate the dates and times of intervention in advance.

Description of Services Provided

The elyadata.com website aims to provide information on all of the company's activities. Elyadata strives to provide information as accurately as possible but cannot be held liable for omissions or inaccuracies in updates.

All information is provided for guidance only and is subject to change. It is provided subject to any changes made since it was posted online.

Technical Data Limitations

The site uses JavaScript technology. The user agrees to access the site with up-to-date equipment, free of viruses, and an up-to-date browser.

The elyadata.com website is hosted within the European Union in accordance with the provisions of GDPR No. 2016-679.

Intellectual Property and Counterfeiting

elyadata.com owns the intellectual property rights to all elements accessible on the site, including texts, images, graphics, logos, videos, and icons. Any reproduction without prior written permission is prohibited.

Any unauthorized use will be considered an act of counterfeiting and prosecuted in accordance with Articles L.335-2 et seq. of the Intellectual Property Code.

Limitations of Liability

elyadata.com acts as the publisher of the site and is responsible for the quality and truthfulness of the content published.

elyadata.com cannot be held liable for direct and indirect damages caused to the user's equipment during access to the site, resulting from the use of inadequate equipment or a software bug.

Personal Data Management

The Client is informed of the regulations: Law of 21 June 2014 for trust in the Digital Economy, Data Protection Act of 6 August 2004, and GDPR No. 2016-679.

7.1, Data Controllers

Data controller: ELYADATA, represented by Salim Jouili. Each processing operation is conducted in compliance with applicable legal provisions.

7.2, Purpose of Data Collection

Elyadata may process data to:

  • Enable navigation and service management (login, billing, history)
  • Prevent and fight computer fraud (IP address, hardware, hashed password)
  • Improve navigation on the Site
  • Conduct satisfaction surveys (email)
  • Conduct communication campaigns (phone, email)

Elyadata does not sell your personal data, which is used only out of necessity or for statistical purposes.

7.3, Rights of Access, Rectification and Objection

In accordance with GDPR, you have the following rights:

  • Right of access (Art. 15) and rectification (Art. 16)
  • Right to erasure (Art. 17) when data is inaccurate or outdated
  • Right to withdraw consent (Art. 13-2c)
  • Right to restriction of processing (Art. 18)

7.4, Non-Disclosure of Data

Elyadata undertakes not to transfer the collected Information outside the European Union without informing the client. Elyadata undertakes to take all necessary precautions to preserve the security of data and does not collect any "sensitive data".

Security

Elyadata uses networks protected by standard devices: firewalls, pseudonymization, encryption, passwords. All reasonable measures are taken to protect your data against loss, unauthorized access or disclosure.

Incident Notification

No method of transmission over the Internet is completely secure. In the event of a security breach, we would notify affected users so they can take appropriate steps, in compliance with our legal obligations at the national and European level.

No personal information is published without the user's knowledge, exchanged, transferred or sold to third parties. Only the hypothesis of a takeover of Elyadata would allow the transmission of said information to the potential acquirer, subject to the same obligations.

Cookies and Web Beacons

9.1, Cookies

A "cookie" is a small file sent to the User's browser and stored in their device. It contains information such as the domain name, Internet service provider, operating system and date of access. Cookies are not likely to damage the device.

The Cookies used help improve the content of the Site and navigation. The User can configure their browser to refuse Cookies. Some features may then no longer be available.

9.2, Web Beacons (tags)

Elyadata may use web beacons (transparent GIFs, action tags) deployed via a web analytics specialist partner. This technology makes it possible to assess visitor responses and the effectiveness of site actions.

Applicable Law and Jurisdiction

Any dispute in connection with the use of the elyadata.com website is subject to French law. Exclusive jurisdiction is attributed to the competent courts of Paris.
